SHIPPING AND PRODUCT GUARANTEE

Shipment & Delivery

Products can be shipped only to a street address within the 50 United States, the District of Columbia, Puerto Rico, and Guam, or in most cases Military APO/FPO or Military P.O. Box addresses.

The term ‘shipping’ or ‘ship’ includes the commencement of shipping Product in an order for multiple Purchases or where the Product purchased consists of components that must be shipped separately. For example, your order may consist of (1) several different Product(s), (2) a quantity of the same Product, or, (3) a single Product with several component parts the size of which might require them to be shipped in separate packages. In all such orders, PURE will attempt to combine individual packages together so that they arrive at the same time; however, when that is not possible, PURE commences shipping by shipping individual packages in the order the soonest they are available and conditions permit.  In these instances, our notification to you that your order has ”shipped,” marks the time when shipping has commenced; it does not mean that all Product in the order have shipped at that time. You agree that credit cards and debit cards are to be charged on the date of inventory reservation for the order, not the date of shipping.

Your order will be fulfilled by the estimated delivery date set out in the Shipment Confirmation, or as otherwise set out on the website. If PURE is unable to meet the estimated delivery date, a PURE representative will contact you with a revised estimated delivery date by phone call or email.

Please note that unless otherwise stated on the website, delivery estimates are just that.  They are not guaranteed delivery times and should not be relied upon as such.

Special Handling

Some PURE Products require special handling as specified by federal, state, and local regulations governing the shipping of these items. The method of shipment for these Products is dictated by these legal regulations. PURE complies with these regulations and therefore the shipment of some Products to certain locations may not be possible. Please contact the PURE Customer Service Department for additional shipping information.

Shipment to APO/FPO/PO Boxes

Most PURE Products may be shipped to Military APO/FPO or Military P.O. Box addresses, but some restrictions may apply. Orders being sent to Military P.O. Boxes or Military APO/FPO addresses must be shipped via United States Postal Service and cannot be shipped via overnight or 2nd day service.

Shipments to Alaska, Hawaii, Puerto Rico and Guam

Most PURE Products can be shipped to Alaska, Hawaii, Puerto Rico and Guam, but some restrictions and additional shipping and handling charges may apply. Priority shipping methods (overnight or 2nd day service) are not available for certain locations in Alaska, Hawaii, Puerto Rico and Guam.

International Deliveries

If you order Products from the website for delivery to an international delivery destination, your order may be subject to import duties and taxes which are applied when the delivery reaches that destination.  Please note that PURE has no control over these charges and cannot predict their amount.  You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order.

You must comply with all applicable laws and regulations of the country for which the Products are destined; PURE will not be liable or responsible if you break any such law.

Non-Deliverable Orders

In some cases, an order may be returned to PURE if the carrier is unable to deliver it to the specified shipping address due to no fault of PURE.   In such cases and at your request, PURE will attempt to re-ship the Products. Please be aware that you will be charged the delivery cost for both the original failed shipment and any subsequent delivery or attempted delivery.

Product Return Policy

If for any reason you are not completely satisfied with any PURE Product, you or the PURE consultant may return the unused portion of the Product within 30 (thirty) days from the date of Purchase provided that a completed Return Form and the original Customer Order Form with Purchase date accompanies the Products. For Products returned pursuant to this policy, PURE will, at your option:

(a)  refund the amounts paid for the Products by crediting 100% of the Purchase price for the unused portion of the order (less shipping and handling charges) and sales tax by (i) check or (ii) on the credit card used to make the Purchase; or

(b)  exchange the returned Product for a Product of equal or lesser value as selected by you. The unused portion of the original order will be refunded and a new order will be submitted, as well as applicable sales tax and shipping and handling charges.  Calculations for the unused portion of the order will be total value of the order (less shipping, handling, and tax) divided by the total amount ordered, then multiplied by the total of unused product being returned.

To cancel an order or contract, please contact PURE Customer Services telephone line or e-mail us at info@puremicrofiber.com to tell us. You may wish to keep a copy of your cancellation notification for your own records. If you send us your cancellation notice by e-mail or by post, then your cancellation is effective from the date you sent us the e-mail or posted the letter to us.

Risk of Loss; Title

All Product Purchased from our website are made pursuant to a shipment contract.  This means that, subject to payment of the Products in full, the risk of loss and title for such Product(s) pass to you upon PURE’s tender of the Product to the carrier.

Withdrawal of Products

PURE reserves the right to withdraw, remove or edit any materials, content, or Product from this website at any time. PURE will make its best efforts to always process all orders; however, there may be exceptional circumstances which mean that PURE may need to refuse to process an order after you have received an Order Confirmation, which PURE reserves the right to do at any time, at its discretion.

PURE will not be liable to you or any other third party by reason of PURE withdrawing any Product from this website, whether it has been sold or not, removing or editing any materials or contents on this website or for refusing to process or accept an order after it has sent you the Order Confirmation.

Warranties – Products

PURE clearly displays Product warranties alongside or near the actual Product to which the warranty relates. If no such Product warranty is displayed, in the alternative, PURE provides a default warranty period of 30 days for Products.

DISCLAIMER OF WARRANTIES – PRODUCTS

Except as set out above ‘Warranties – Products’, PURE HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR PARTICULAR PURPOSE.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.

Limitation on Liability – Products

IN NO EVENT WILL PURE, ITS  SUBSIDUARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS AND/OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE website, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE website OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH THE website OR SUCH OTHER WEBSITES, INCLUDING FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OR CORRUPTION OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification – Products

You agree to defend, indemnify and hold harmless PURE, its affiliates and licensors and their respective officers, directors, employees, contractors, agents, licensors and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) resulting from your violation of these Terms or your (i) unauthorized use of the Products, and/or (ii) use of the Products otherwise then as instructed, other than as expressly authorized in these Terms.

Intellectual Property Rights

The entire contents of the website (including all downloads, information, software, text, displays, catalogues, images, video and audio) and the design, selection and arrangement thereof, are owned by PURE or its licensors and are protected by United States, Canada, European Union and international laws regarding copyrights, patents, trademarks, trade secrets and other intellectual property, industrial or proprietary rights.

You are permitted to use the website for your personal or legitimate business purposes.  Except where explicitly authorized by PURE you must not copy, modify, create derivative works of, publicly display or perform, republish, download or store, or transmit any of the material on our website, or the website itself without the prior written consent of PURE in each instance.

You must not:

• Modify the paper or digital copies of any materials available from this website; or
• Use any illustrations, photographs, video or audio sequences or any graphics separately from the accompanying text;
• Delete or alter any copyright, trademark and other proprietary notices appearing on such materials.

No right, title or interest in or to the website or any content on the website are transferred to you, and all rights not expressly granted are reserved by PURE and/or its licensors. Any use of the website not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark and other laws.
